Why is the sale of pyrotechnics prohibited?
Due to the martial law in Ukraine, there is a strict ban on the sale of any pyrotechnic products. There are no exceptions, the lawyer emphasized. The legislation provides for administrative liability for violating this restriction.
"The sale of pyrotechnics is prohibited without exception. However, questions arise regarding their use. For instance, weak charges can be used, but selling or purchasing them is not allowed," explained Igor Shavrov.
What is considered a "weak charge"?
The lawyer clarified that pyrotechnic products are classified into categories. In particular:
- Category F1 includes weak charges, such as firecrackers, which can theoretically be used once. They do not produce loud noise and are considered less dangerous.
However, even such products are prohibited from being sold or advertised.
Legal nuances to pay attention to
- Selling pyrotechnics without displaying a price is a violation of trade rules.
- Advertising prohibited products is also a violation of legislation.
- Selling without a fiscal receipt is punishable as a violation of tax legislation.
Liability for violations
According to Shavrov, the fine for such actions can amount to 100% of the value of the sold goods. For example, if an offender sold pyrotechnics worth 1000 hryvnias, the fine would also be 1000 hryvnias.
