The Cassation Criminal Court has upheld the previously issued sentence for a pensioner from Dnipro, who was given 5 years for cutting off a homeless man's nose, reports "Vидомо" citing Judicial Reporter.
The incident occurred on May 25, 2022, on Heroes Avenue in Dnipro, during a conflict between the men. The homeless man asked the man for either a cigarette or 5 hryvnias, and the man responded with an insult, to which the homeless man retaliated with an insult of his own. Later, the accused followed the homeless man, took his cart, and rolled it behind a building. In the yard, the man began to beat the homeless man, grabbed him by the head, and cut off his nose with an unknown object. The victim sought help from a kiosk employee, but she was frightened. He then turned to a passing woman, who called for an ambulance. There were pools of blood at the scene, and the police found a fragment of the nose.
The October District Court of Dnipro sentenced the accused to 5 years in prison on June 8, 2023. No preventive measures were applied to the pensioner, who is now 63 years old.
The appellate court upheld the sentence and, among other things, dismissed the defender's claims that the accused was acting in self-defense against the victim's attack.
