Accordingly, the issuance of summons continues, and you may receive one even at home when the military enlistment office knocks on your door. However, the question arises: can you refuse to open the door for them? Attorney Anastasia Grigorieva addressed this in a comment to Novini.LIVE.
"If a conscript opens the door to the military enlistment office and the State Security Service employees — in order for them to enter the conscript's apartment, the employees must present appropriate documents and their official ID. The citizen has the right to verify these documents," the attorney explained.
She added that the military enlistment office employees enter the residence with prior consent or after notifying the property owner. In any case, if the conscript opens the door but refuses to sign or accept the summons, they will bear responsibility for that.
Furthermore, refusing the summons in this situation does not exempt one from the obligations that may be specified in it.
"However, if the conscript does not allow the military enlistment office and the State Security Service employees into their home, no one has the right to forcibly enter the apartment (except in cases defined by law). The right to property is inviolable and protected by the Constitution of Ukraine and the laws of Ukraine," the attorney added.
If the military enlistment office and State Security Service employees entered your home without permission, it is considered an abuse of power and official authority, for which criminal liability is provided.
